STATUS: United Furniture/Brick Class Action

On January 14, 2008 Steinman Preovolos will be appearing in New Westminster Supreme Court for a "Case Management Conference" with Mr. Bruce Lemer, Plaintiffs' counsel in a similar intended class action started on August 16, 2006.

Two similar class actions cannot proceed at the same time. Plaintiffs' counsel in two similar class actions either have to consolidate their actions and work together or apply to the Supreme Court for an order granting counsel in one of the actions "Carriage" to continue on behalf of all plaintiffs.

We believe it would be in the best interests of our clients and other persons interested in joining the action against United Furniture Warehouse and The Brick to have Steinman Preovolos represent all Plaintiffs.

As a result, in the first half of 2008, a "carriage motion" will be heard in Supreme Court to determine whether Steinman Preovolos can proceed on behalf of all plaintiffs.

We are optimistic that we will prevail in the carriage motion and are planning to proceed with a "certification application" under the Class Proceedings Act in the second half of 2008 to have the case officially declared a class action.
